THIS IS AN AGREEMENT BETWEEN YOU OR THE INSTITUTION THAT YOU REPRESENT ("THE SCHOOL") AND YUVAASOFT TECHNOLOGIES PVT. LTD. ("YUVAASOFT", "WE") GOVERNING YOUR USE OF GOFINICKY SMARTSCHOOL ("THE SERVICE").
1. Acceptance of Terms
By registering for or using GoFinicky SmartSchool ("the Service"), the school and its authorized users agree to these Terms of Service.
2. Description of Service
SmartSchool is a communication platform for Day Care, Play School, Nursery, LKG, and UKG institutions, covering announcements, special announcements, homework announcements, fee announcements, leave requests, feedback, and a shared monthly calendar.
3. Eligibility and Account Registration
The school is responsible for the accuracy of information provided at registration and for obtaining any necessary parental consent before enrolling parent and student contact details onto the platform.
4. Subscription, Billing, and Refunds
- Pricing: Subscription fees are billed per student, as communicated to the school at the time of registration or in the applicable order confirmation. Fees are not published on this website and are confirmed directly with each school before signup.
- Free Trial: A 14-day free trial is available with full feature access and no credit card required. Nothing is charged during the trial, so no refund applies to it.
- No Auto-Debit: Subscriptions are billed manually, with no automatic renewal and no auto-debit. You are only charged when you actively choose to renew.
- Refunds for Billing Errors: If you are charged a duplicate amount or an incorrect amount due to an error on our end, contact info@yuvaasoft.com within 30 days of the charge. Once verified, the erroneous amount will be refunded to your original payment method within 5–7 business days.
- Refunds for Service Non-Delivery: If the platform is completely inaccessible due to a fault on Yuvaasoft's side for more than 48 continuous hours within a billed month, a prorated credit or refund for the affected period may be issued at our discretion.
- No Refund for Mid-Cycle Cancellation: Because billing is manual with no auto-debit, once a billing period is paid and the service has been made available, the fee for that period is non-refundable if the school chooses to stop using the service partway through. Simply don't renew to avoid the next cycle's charge.
- How to Request a Refund: Email info@yuvaasoft.com with the subject "Refund Request," including your registered school name and payment reference.
5. Acceptable Use
Users agree not to transmit unlawful or defamatory content, attempt unauthorized access to other schools' accounts, or disrupt platform security.
6. What Is Not Included
SmartSchool does not currently include attendance tracking, gradebooks, report card generation, or online fee payment collection. These are not part of the platform today.
Platform Focus: GoFinicky SmartSchool is dedicated specifically to school-to-parent communication, notices, homework feeds, leave administration, and event calendars for early learning institutions.
7. Platform Availability
We aim for high platform availability to support seamless communication between schools and parents, but do not guarantee a specific uptime percentage. Routine maintenance is scheduled during off-peak hours with advance notice provided where practicable.
8. Intellectual Property
All software, design, and content related to GoFinicky SmartSchool are the property of Yuvaasoft Technologies Pvt. Ltd. Schools receive a limited, non-exclusive license to use the Service.
9. Data Ownership and Processing Relationship
The school acts as the Data Fiduciary under the DPDP Act for the personal data it enters into SmartSchool. Yuvaasoft acts as a Data Processor, processing that data solely to deliver the Service.
10. Termination
Either party may terminate with 30 days written notice. Yuvaasoft may suspend access for violation of these Terms. Upon termination, the school may export its data within 30 days.
11. Limitation of Liability
To the maximum extent permitted by law, Yuvaasoft is not liable for indirect, incidental, or consequential damages arising from use of the Service.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Coimbatore, Tamil Nadu.
13. Changes to Terms
Continued use after changes constitutes acceptance of the revised Terms.
